Agreement

Shotboard is operated by MaitoAI, LLC, a Delaware limited liability company with an address at 1111b South Governors Ave STE 25502, Dover, DE 19904, United States.

By downloading Shotboard, creating an account or using the Service, you agree to these Terms. If you use Shotboard for a company, client or other organization, you represent that you have authority to bind it.

The Service

Shotboard lets you generate and edit images, video, audio and text with third-party AI models, research ads, import links, transcribe and read media, and arrange everything on boards. Supported features vary by plan, macOS version, provider and availability.

Shotboard does not give you ownership of, or additional rights to, third-party models, accounts, software, content or data sources.

Your account and keys

You are responsible for your account, the AI provider accounts and API keys you connect, and activity under them. Keep credentials secure and contact us promptly if you believe your account has been compromised.

You may not share accounts, use another person's credentials, bypass plan limits, or create accounts to evade enforcement.

Your content

You keep your rights to the prompts, images, videos, files and other materials you put into Shotboard and to what you make with it, subject to the rights of others and the terms of the AI providers you use.

Your boards are stored on your Mac. When you ask Shotboard to do something, it sends the relevant content to the AI providers and services that task needs. You grant us the permissions needed to provide the Service in that way.

You are responsible for having the rights and permissions needed for the content you use, including other people's ads, videos, likenesses, brands and music.

AI output

AI output can be inaccurate, unoriginal or unsuitable for your purpose, and may resemble existing work. Review it before you publish or rely on it, especially in advertising, where claims and endorsements may be regulated.

We do not guarantee the accuracy, originality, legality or fitness of AI output. Rights to output may also be governed by the relevant provider's terms.

AI providers and connected services

Shotboard works with third-party AI providers and services, such as fal, Replicate, Higgsfield, xAI, Google, OpenAI and Anthropic, and the AI subscriptions and tools you connect. You are responsible for complying with their terms, usage policies and limits. Provider charges are billed by them to you and are separate from Shotboard's. We add no markup.

Third parties may change, restrict or stop features used through Shotboard. We are not responsible for their outages, model behavior, pricing, policy changes or data practices.

Acceptable use

You may not use the Service to:

• Violate law, sanctions, export controls, privacy rights, intellectual property rights, platform policies or advertising rules.
• Create deceptive, defamatory, harassing, sexually explicit, exploitative or otherwise harmful content, including misleading ads or deepfakes of real people without their consent.
• Impersonate people or organizations, or access accounts, systems or data without permission.
• Collect or misuse other people's personal information without the required consent and legal basis.
• Interfere with the Service, reverse engineer it except where the law allows, or resell access to it.

Plans, billing and taxes

Shotboard has a free plan and a paid Pro plan. Prices, limits and included features are shown on our pricing page and in the app. New accounts may get a free Pro trial; when it ends, the account returns to the free plan unless you subscribe.

Subscriptions renew until cancelled. Payments are processed by Stripe. Fees are non-refundable except where required by law or expressly agreed in writing. You are responsible for applicable taxes.

We may change prices, limits and features going forward. If you do not agree to a change, you can cancel before it applies to you.

Updates and availability

Shotboard updates itself to new versions. We may add, change or remove features, and the Service is provided without uptime guarantees. Provider outages, rate limits and macOS changes may affect what works.

Intellectual property

Shotboard's software, name, logo and design are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service under these Terms. Open-source components remain under their own licenses.

Feedback

If you send feedback or suggestions, including through the app's Feedback button, you grant us the right to use them without restriction or compensation.

Copyright and rights complaints

If you believe content made or shared with Shotboard infringes your rights, contact support@maito.app with the work or right at issue, where it appears, your contact details, and any statements required by law.

Suspension and termination

You may stop using Shotboard at any time. We may suspend or end access to your account if you violate these Terms, fail to pay, create risk for others, or if required by law. Boards stored on your Mac stay on your Mac.

Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and uninterrupted or error-free operation.

Limitation of liability

To the fullest extent permitted by law, MaitoAI, LLC and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or lost profits, revenue, data, goodwill, or provider charges you incur.

Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

Indemnification

You agree to defend, indemnify and hold harmless MaitoAI, LLC and its affiliates, officers, employees and contractors from claims, damages, losses and costs arising from your content, your use of the Service, or your violation of these Terms, third-party terms, law or the rights of others, to the extent permitted by law.

Changes to these Terms

We may update these Terms. If we make material changes, we may notify you in the app, by email, or by updating the date on this page. Continuing to use Shotboard after they take effect means you accept them, subject to applicable law.

Governing law

These Terms are governed by Delaware law, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires a different forum. Nothing in these Terms limits mandatory consumer rights.
